END USER LICENSE AGREEMENT

This is a legal agreement between you, the end user (either an individual, or a legal entity such as a Company) and Alien Invention.

LIMITED USE LICENSE:

Alien Invention grants you the limited right and license to install and use one copy of this "SOFTWARE" solely and exclusively for your personal use on one device only. All rights not specifically granted under this Agreement are reserved by Alien Invention. This SOFTWARE is licensed, not sold. Your license confers no title or ownership in this SOFTWARE and should not be construed as a sale of any rights in this SOFTWARE.

OWNERSHIP:

All title, ownership rights, and intellectual property rights in and to this SOFTWARE and any and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, animation, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, and any related documentation) are owned by Alien Invention or its licensors. This SOFTWARE is protected by the copyright laws of the United Kingdom, international copyright treaties and conventions and other laws. This SOFTWARE contains certain licensed materials, and Alien Invention's licensors may protect their rights in the event of any violation of this Agreement.

YOU SHALL NOT:

Use this SOFTWARE, or permit use of this SOFTWARE, on more than one handheld device, PDA, or computer at the same time.
Make copies of this SOFTWARE or any part thereof, or make copies of the materials accompanying this SOFTWARE. Use the SOFTWARE, or permit use of this SOFTWARE, in a network, multi-user arrangement or remote access arrangement, including any online use, except as otherwise explicitly provided by this SOFTWARE and subject to acceptance of the terms and conditions of an appropriate subscriber agreement and terms of use or service.
Sell, rent, lease, license, distribute or otherwise transfer this SOFTWARE, or any copies of this SOFTWARE, without the express prior written consent of Alien Invention.
Reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works of this SOFTWARE, in whole or in part.
Remove, disable or circumvent any proprietary notices or labels contained on or within the SOFTWARE.
Export or re-export this SOFTWARE or any copy or adaptation in violation of any applicable laws or regulations.
Modify, Add, Remove to any snapshot image created by yourself of this SOFTWARE (including watermarking) without prior consent of Alien Invention.

LIMITED WARRANTY:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALIEN INVENTION DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING PRODUCT MATERIALS. THE LIMITED WARRANTY CONTAINED HEREIN GIVES YOU SPECIFIC LEGAL RIGHTS.

LIMITATION ON DAMAGES:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALIEN INVENTION SHALL NOT BE LIABLE FOR ANY OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS ALIEN INVENTION PRODUCT, EVEN IF ALIEN INVENTION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, ALIEN INVENTION'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE.

TERMINATION:

Without prejudice to any other rights of Alien Invention, this Agreement will terminate automatically if you fail to comply with its terms and conditions. In such event, you must destroy all copies of this SOFTWARE and all of its component parts.

INJUNCTION:

Because Alien Invention would be irreparably damaged if the terms of this Agreement were not specifically enforced, you agree that Alien Invention shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to breaches of this Agreement, in addition to such other remedies as Alien Invention may otherwise have under applicable laws.

INDEMNITY:

You agree to indemnify, defend and hold Alien Invention, its partners, affiliates, contractors, officers, directors, employees and agents harmless from all damages, losses and expenses arising directly or indirectly from your acts and omissions to act in using the Product pursuant to the terms of this Agreement.
